Specific Conditions for Use of Artificial Intelligence (AI) Services

1. Scope, Service Description

1.1. These Specific Conditions apply in addition to the world4you´s General Terms and Conditions (GTC), both for the use of AI systems (Software-as-a-Service) and for the provision of access to AI models and their API interfaces (Platform-as-a-Service), hereinafter collectively referred to as AI Services.

1.2. We will provide You with the AI Services specified in the ordering process or service description. The AI Services process the inputs provided by the You (Input) to generate and produce the corresponding results (Output) by means of automated processes.

1.3. You acknowledge that the AI Services are based on statistical patterns and probabilities. Due to this mode of operation, the Output may be erroneous, misleading, incomplete, or inappropriate. Accuracy, completeness, legality, originality, or suitability of the Output cannot be guaranteed.

1.4. You are obligated to independently and responsibly verify each generated Output for its suitability for the specific intended use before using, publishing, or relying on it as a basis for research, business or legal decisions.

1.5. You must not use AI Output in high-risk or sensitive contexts without appropriate review. You must not use our AI Services for medical, legal, financial, or other professional advice. The same applies to safety-critical applications. Any Output on these topics is for informational purposes only and does not substitute consultation with qualified professionals and subject-matter experts.

1.6. You acknowledge that the underlying AI models of the AI Services or the underlying AI systems may originate from third-party providers. You are obligated to observe and comply with the respective terms of use of the third-party provider(s) (available here). In the event of a breach of these third-party terms by You, We are entitled to terminate the provision of services with immediate effect.

2. Requirements for Your Input and Rights of Use

2.1. You undertake to ensure that the Input entered, uploaded, or transmitted into the AI Services does not violate applicable laws. Reference is made to the GTC in this regard.

2.2. You undertakes to use the AI Services and the generated Output exclusively in accordance with these Special Conditions, the General Terms and Conditions, applicable law (including copyright and trademark law), and regulatory requirements. The use of the AI Services to create, distribute or publish, or use illegal, discriminatory, defamatory, harmful to minors, or otherwise impermissible content is prohibited.

2.3. All intellectual property ownership and usage rights to the Input provided by You remain with You. Input and Output data may be used by Us exclusively for the technical processing and provision of the AI Services to You for the purposes of ensuring technical security, error correction, and abuse of the AI Services prevention. We do not use the Input and Output data for, further development, training, or retraining of the underlying AI model or other models.

2.4. In order to ensure the stability, security, and availability of the AI Services for all of our customers, We are entitled to technically limit the number of permissible Inputs per unit of time to an appropriate extent ("Rate Limiting").

2.5. The AI Services are intended for interactive use by a natural person, unless expressly provided otherwise in the service description. Inputs shall be entered directly by the human user, in particular via keyboard, voice input, eye tracking or comparable assistive technologies. The reference framework for use in accordance with the intended purpose shall be the input and request volume that a natural person can physically generate themselves using the respective input method within an ordinary working day.

2.6. Misuse shall be deemed to exist in particular where the Customer exceeds the framework set out in Section 2.5 (for example, by the mass insertion of pre-prepared or externally generated content, automated or repetitive queries, parallel sessions across multiple devices, script-, macro- or software-controlled use including RPA tools, as well as feeding AI output directly back as new input), uses the AI Services other than as intended for the Customer's own purposes (in particular by reselling the AI Services or access thereto to third parties, otherwise making them available to third parties for consideration or free of charge, disclosing account access credentials, or permitting third parties to access the account), circumvents the technical limitation under Section 2.4, or uses multiple accounts to circumvent measures.

2.7. Where there is a reasonable suspicion of misuse, world4you shall be entitled, in compliance with the principle of proportionality, to take provisional and reversible measures, in particular further throttling, the temporary switch to a less powerful AI model (downgrade) or the temporary suspension of access. Where a violation has been established, such measures may be applied permanently. The right of either party to terminate the contract for cause in accordance with the General Terms and Conditions remains unaffected. Prior to taking any measure, world4you shall inform the Customer and give them the opportunity to comment, provided that this is possible and not detrimental to remedying the violation.

3. Changes to AI Models and Components

We reserve the right to shut down, discontinue, modify, or replace the underlying models/components in the AI Services or parts thereof at any time with reasonable notice to You, insofar as this is deemed necessary by Us for technical, economic, legal, or regulatory reasons.

4. Use of Third-Party Image Content

4.1. For certain SaaS AI Services, generated Outputs may contain content from third-party image databases (Unsplash). Unless otherwise indicated, We hereby grant You a non-exclusive, royalty free, worldwide license to use this image content as an integral part of the generated Output (e.g., within the created website) in accordance with the terms of this agreement.

4.2. The use of this image content is additionally subject to the respective license terms of the third-party provider (https://unsplash.com/license), which You are obligated to comply with. You are prohibited from extracting the image content in isolation from the Output, downloading it, and/or reselling or distributing it as independent image content (e.g., to build a similar or competing service, or as a stock photo).

4.3. We do not provide any warranty or guarantee and therefore cannot accept any liability that the image content is free from third-party rights (in particular copyright, trademark rights, or personality rights of depicted persons). Within the scope of Your verification obligation pursuant to clause 1.4, You alone are responsible for checking, prior to publication of the Output, whether the specific use of the image content requires additional clearance or licensing of third-party rights.

4.4. You shall indemnify Us on first demand against all third-party claims arising from an unauthorized or unlawful use of the image content by You (e.g., breach of license terms or third-party rights after publication).

5. Liability and Indemnification

5.1. We are not liable for damages arising from Your reliance on the accuracy of the Output, in accordance with clause 1.3.

5.2. You shall indemnify Us on first demand against all third-party claims (including reasonable costs of legal defense) asserted against world4you due to a breach by You of these Specific Conditions, applicable law, the GTC, or due to the unlawful use of the generated Output by You.
